These terms govern individual business orders for a one-off company-data export from this website, operated by Martin Adamec, IČO 19552319. An enquiry is a nonbinding request for a quotation, not an order. An export is a file with the content and format agreed in the quotation. Individually agreed provisions take precedence over these terms, subject to mandatory law.
The offer is intended for business customers acting in connection with their activity. Business status does not by itself remove statutory protection. In particular, rights granted by Polish law to qualifying sole traders whose contract is not of a professional nature remain unaffected. No declaration on this website waives such rights.
The contract is concluded by acceptance of an individual written quotation, including by email, on the terms stated in it. Before acceptance, the parties agree on the territory, filters, fields, format, record count, data reference date, price, currency, taxes, payment and delivery terms, licence, applicable terms and remedy arrangements. The quotation also identifies its validity and the contract language. Proposed changes require agreement; submitting a form alone creates no payment obligation.
The agreed export is supplied once; subscriptions and updates require a separate agreement. Public-source records may be incomplete or become outdated. Coverage and availability of individual fields depend on the source and selection. The quotation specifies the promised scope and any known limitations; there is no general percentage tolerance. We do not guarantee that every email or telephone number is reachable or that using the data will generate sales. These limitations do not exclude rights arising from nonconformity with the agreed specification.
The price, currency, applicable taxes, payment method and due date are agreed individually in the written quotation. Any advance payment must be expressly agreed. Tax treatment is stated in the quotation and invoice as required by applicable law. No fixed payment period or undisclosed charge is imposed by these terms.
The written quotation sets the delivery date, file format and delivery method, for example an email attachment or download link. Any download expiry is stated before acceptance. If delivery fails or the file cannot be opened, contact us with the order reference so that we can agree and provide the appropriate remedy. A contact-form success page is not proof that the recipient has received an email.
The quotation defines the permitted use and duration of the licence and any conditions for sharing or redistribution. Any rights in the selection or arrangement of the database exist only to the extent recognised by law; we do not claim ownership of public facts. Third-party rights and source licences remain applicable. For OpenStreetMap material, attribution to OpenStreetMap contributors and the applicable ODbL conditions must be respected; these terms do not restrict rights granted by that licence.
Buying an export is neither consent to marketing nor an independent legal basis for processing personal data. The buyer must establish its own lawful purpose and basis, fulfil information duties, respect objections and applicable communications rules. Article 398 of the Polish Electronic Communications Law requires prior consent for the covered use of telecommunications terminal equipment or automated calling systems to send commercial information, including direct marketing; business recipients are also covered. The export includes no such consent and no guarantee of do-not-call screening. Do not use it for sensitive personal-data processing or consumer credit or eligibility decisions. Where legally required, parties must cooperate on corrections, erasure and restrictions; the controller’s own duties remain unchanged.
Send a complaint to the contact email below, identifying the order, the issue and, where useful, affected examples. Price, delivery and remedy arrangements are agreed in the written quotation; correction, replacement or an appropriate refund will be handled as agreed and as required by law. If no special remedy has been agreed, applicable statutory rights govern. These terms impose no short reporting deadline or blanket exclusion of defect remedies.

Liability is governed by the applicable law and lawful individual agreements. These terms introduce no contractual penalty, indemnity, general liability cap or exclusion of mandatory rights. Commercial results depend on circumstances outside the export; no promise of responses, new customers or revenue is made.
When personal data is disclosed to a buyer acting as an independent controller, each party remains responsible for its own processing and applicable GDPR duties. A purchase does not itself create a processor agreement or remove the supplier’s disclosure obligations. Any different processing arrangement and any international transfer must be assessed before supply. Website and enquiry data are explained in the privacy policy; database records in the GDPR information notice.
Business purchases do not automatically carry consumer withdrawal rights. Where the law extends withdrawal or other consumer protections to a qualifying sole trader, these rights remain in force. No blanket waiver, automatic loss of withdrawal rights on delivery or no-refund rule is created here. Statutory rights concerning nonperformance or defects remain unaffected.
Applicable law and court jurisdiction follow the relevant statutory and conflict-of-law rules, unless a lawful individual agreement provides otherwise. These terms impose no exclusive foreign court or arbitration clause and do not displace mandatory protections.
The version supplied with the accepted quotation applies to that contract. Later website changes do not retrospectively change it. Amendments require agreement between the parties. Language versions provide the same information; any controlling contract language is agreed in the quotation without limiting mandatory rights.
